is *solely* so that BSF and current management can point to it as evidence of "good faith" attempt to prosecute the suit to the greatest extent possible. "We wouldn't do something so dumb unless we reaaaalllly beeeeleeeeeeved!".  
 
In short it's just an additional CYA for BSF and current management when the BK trustee starts looking over where why the money went.  
 
Hell or high water, I expect SCOX to fold completely before the PSJ hearings in March. The rats, IMO, are now going to be scrambling for as much plausible deniability as they can get.
