Novell 453. - not screwing IBM Once again I stress that this is supposition, not knowledge. I suspect that IBM and Novell's lawyers (or more probably executives who direct them including corporate counsel) have been working together all along. Early this year (or late last, I forget the exact timing) the pace of Novell picked up markedly. I strongly suspect that IBM gave a "go ahead" to Novell to terminate with extreme prejudice. Until that time Novell had been mostly in a holding pattern. I can only guess why, but IBM either decided that they could never get whatever they wanted (explicit validation by the courts, most likely) or they got what they wanted (access to the MS agreement and accompanying documentation?) and decided that playing it out wasn't worth the trouble. Bottom line is, right now I don't think IBM cares if SCOX goes BK Monday morning or hangs on until the Nazgul get their feast. Blue Gene ... these guys have strategic thinking down to a science. Literally. Without knowing the "parameters" we can only guess at their true intentions, and mostly surmise after the fact from their behaviors. -- TWZ |
